1. Who we are

AIViralThumbs (“we”, “us”, “our”) operates the website aiviralthumbs.com and related services (collectively, the “Service”).

2. Acceptance of terms

By accessing or using the Service, you agree to these Terms of Use (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

3. Key definitions

Input(s): text prompts, images, uploads, settings, and other content you provide to the Service.
Output(s): images and other content generated by the Service in response to your Inputs.
Credits: metered units that allow usage of certain features or model workloads.
Subscription: a paid plan granting time-based access to features and/or Credits.

4. Eligibility & accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms.
You are responsible for your account, credentials, and all activity under it. Keep your password secure and notify us of any unauthorized use.
We may refuse, suspend, or terminate accounts to protect the Service or comply with law.

5. Payments, Credits & Refunds

Purchases are one-time. We do not offer automatic renewals.
Credits are units used to generate/export assets.
No Refunds / No Cash Redemption. All credit purchases are final.
Credits have no cash value, Credits cannot be redeemed for money, Credits are non-refundable (including unused/partial use, platform disapprovals, or performance).
By purchasing Credits you are able to use it instant.

6. Licenses: your inputs & your outputs

6.1 Your Inputs

You retain ownership of your lawful Inputs. You grant us a worldwide, royalty-free license to host, process, transmit, and display Inputs solely to provide and improve the Service (including security, safety, and quality control).
If you upload third-party content, you must have all necessary rights, licenses, and consents.

6.2 Your Outputs

Subject to these Terms and applicable law, we assign or grant you a non-exclusive, worldwide license to use, reproduce, modify, and commercialize Outputs generated under your account, to the extent permitted by the rights you hold in the Inputs and any third-party rights. You are responsible for ensuring your use of Outputs complies with applicable laws and third-party rights (e.g., copyrights, trademarks, publicity/privacy rights, platform policies).
Outputs may not be unique and similar or identical content may be generated for others.
We may use aggregated, anonymized usage data and non-personal telemetry to improve the Service. We do not claim ownership over your lawful Inputs or Outputs.
You may opt out of limited use of your content for model quality review where offered in your settings, if technically available.

7. Acceptable use

You agree not to, and not to allow others to:

Use the Service for illegal activities; violate intellectual-property, publicity, or privacy rights; or breach any platform’s policies (e.g., YouTube, Meta, TikTok).
Create or distribute content that is defamatory, deceptive, fraudulent, hateful, harassing, extremist, sexually explicit involving minors, or that promotes violence, self-harm, or discrimination.
Generate non-consensual intimate imagery, realistic deepfakes of private individuals, or content that meaningfully impersonates others without clear disclosure and lawful basis.
Attempt to extract source code, underlying models, or system prompts; reverse engineer; bypass safety filters; or remove watermarks/attribution where applied.
Scrape, rate-limit evade, interfere with, or overload the Service; use automated bots to exceed allowed quotas; or resell without our written permission.
Upload malware or content that could harm systems or data security.

8. Intellectual property & DMCA

The Service, including our trademarks, branding, site design, and software, is owned by us or our licensors and protected by law.
If you believe content on the Service infringes your copyright, send a DMCA/notice to: [info@aiviralthumbs.com] with: (a) your contact info; (b) identification of the work and allegedly infringing material; (c) a good-faith statement; (d) a statement under penalty of perjury; and (e) your physical or electronic signature.
We may remove content and suspend repeat infringers as required by law.

9. AI specific notices

No guarantee of originality: AI systems may produce Outputs similar to existing works. You should conduct appropriate clearances before commercial use.
Accuracy: Outputs may contain errors, artifacts, or biased results. Always review before publishing.
Safety filters: We may block certain prompts/outputs to meet legal and policy obligations.
Attribution/Disclosures: Some jurisdictions or platforms may require labeling of AI-generated content. You are responsible for any required disclosures.

10. Third-party services

The Service may integrate third-party APIs, models, payment processors, storage, or analytics. Your use of such services may be governed by their terms. We are not responsible for third-party services we do not control.

11. Privacy & data

Our handling of personal data is described in our Privacy Policy. By using the Service, you consent to such processing and to transfers as described therein.

12. Service changes; availability

We may modify, suspend, or discontinue features at any time. We strive for high availability but do not guarantee uninterrupted or error-free operation.

13. Disclaimers

To the fullest extent permitted by law, the Service and all Outputs are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, non-infringement, and accuracy.

14. Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your Inputs or Outputs; (b) your breach of these Terms; or (c) your violation of any law or third-party rights.

15. Suspension & termination

You may cancel your Subscription at any time in your account settings (effective at the end of the current billing period unless otherwise stated).
We may suspend or terminate access immediately for violations of these Terms, legal requests, or security risks. Upon termination, your right to use the Service ceases, but certain sections (e.g., IP, disclaimers, liability limits) survive.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by reasonable means (e.g., in-app notice or email). Your continued use after changes take effect constitutes acceptance.
